Terms and Conditions
Agreement between User and Magic City Occasions (www.magiccityoccasions.com).
Please carefully review the following terms and conditions that govern our services.
By engaging the services of Magic City Occasions, clients acknowledge that they have read, understood, and agreed to the policies outlined in these terms and conditions. If you have any questions or require further clarification, please don't hesitate to contact us.

Services Offered:
Magic City Occasions specializes in providing luxury picnic events and room occasion makeovers. Our services include but are not limited to:
Designing and setting up exquisite picnic experiences in various locations from our pre-approved locations across Miami.
Crafting personalized room occasion makeovers for special events such as birthdays, anniversaries, proposals, and more.
Booking and Reservation:
To reserve our services, clients must contact Magic City Occasions via our website, email, or phone.
Bookings must be made at least 14 days in advance of event date along with the deposit paid at least 14 days in advance to confirm booking.
A non-refundable deposit of 50% of the total quoted price is required to secure the booking. Booking confirmation is subject to availability and is considered finalized only upon receipt of the deposit.
These funds may be transferred via credit card, bank transfer, or other agreed-upon methods. The bond is also payable at this time.
Pricing and Payment:
The final balance of the invoice is due 7 days prior to the agreed date of the confirmed event booking date.
Pricing for Magic City Occasions customized services is available upon request and is subject to change without prior notice.
Pricing for Magic City Occasions pre-made packages are individually priced and only includes items listed in package. Other items can be added onto packages for an additional cost.
Pre-existing packages are priced for set number of guests and client will not exceed total number of guests on the package purchased. Doing so will result in the client being billed an additional $100 per person exceeding the maximum number on the purchased package.
Payment can be made via credit card, bank transfer, or other agreed-upon methods.
Equipment will not be released to the client until full payment has been received. The final balance must be cleared in the hire company’s account prior to collection/delivery. By making full payment the client understands and agrees to the terms and conditions of the hire company.
Security Deposit
Security deposit of $200 is required on all services.
The security deposit will be refunded upon return of equipment in its original condition, less any charges incurred for missing, broken or damaged equipment. Please allow up to 72 hours after return of equipment to allow the hire company to thoroughly check each piece and refund the security deposit.
If the replacement amount exceeds the security deposit paid, the client is liable to pay the hire company the difference. The hire company will issue the client an invoice which is payable within 7 days (the client may also pay the difference in cash upon return of the equipment).
Missing, Broken or Damaged Equipment:
The client is responsible for any missing items as well as breakages and/or damages caused to the event setup or equipment during the event. Any breakages / damages caused to the rented equipment, items or property during the event will be the responsibility of the client and will incur additional charges.
If an item is broken, the client is required to carefully collect the broken pieces (where possible) and return to the hire company. If collecting the pieces is not possible (i.e. a shattered glass) the client should take a photo and send to the hire company for records.
An assessment of damages will be conducted after the event, and any repairs/replacement costs will be billed to the client or taken from the bond.
Hire Period:
Event setup and/or equipment hire is quoted for a 2-hour period only from confirmed start time of booking. Extension to the sitting time will not occur in the event the customer does not arrive on time. The commencement and conclusion time of a booking will remain as per the original agreed booking.

Extended Hire:
The Customer agrees that the booking is for the agreed duration as confirmed at the time full payment for the booking occurs.
A request to extend booking duration must occur at least 4 days prior to the confirmed date of booking and is subject to availability.
No refunds will be issued in the event the extended hire is not fully utilized.
​Extended hire is charged at a rate of $50 per hour if scheduled in advance and $65 per hour if scheduled within 4 days of confirmed event booking date.
Late Policy and Fees:
If guests do not show up within 30 minutes of the scheduled start time, Magic City Occasions team will start clean up and no refunds will be processed.
If guests do not show up, no refunds will be issued and the client will not be able to reschedule their booking.
Cancellation Policy:
Due to our high number of bookings, in the event of cancellation by the client, the deposit is non-refundable.
Cancellations made within 7 days of the event will result in a total forfeiture of the full payment. Magic City Occasions does not provide refunds due to change of mind or wrong decisions. Emergency cancellations must be made 48 hours prior to event or full cost of event will be forfeit.
Rescheduling of booked event will only be permitted once, second cancellation forfeits full amount of cost.
Magic City Occasions reserves the right to cancel or reschedule events due to unforeseen circumstances such as inclement weather or other unavoidable situations. In such cases, alternative arrangements or a full refund will be offered.
Event Changes:
Any changes to the date, time, location, or details of the event must be communicated to Magic City Occasions at least 7 days prior to confirmed booking date and is subject. Requests for changes must be made in writing and are subject to approval by Magic City Occasions. Additional charges may apply for significant changes to the event scope or requirements.
Client is responsible for ensuring that all details provided to Magic City Occasions are accurate and up-to-date.
Any changes requested by the client after the event has been confirmed may incur additional charges or may not be possible depending on availability and feasibility.
Weather and Venue Availability:
In the event of inclement weather, refunds will not be issued. It is the client’s responsibility to have a back-up wet weather option. In the event that the location changes and delivery is being made, the client must provide as much notice as possible. Increased travel fees may be charged.
Date changes will be considered if bad weather is predicted and an alternate venue is not available and is dependent on availability of the picnic equipment.
Location of an event can be changed due to weather the day before the event. For styling events only please have a backup plan as we are more than happy to set the picnic up indoors, under a pergola or on a patio. In the event a new location or reschedule of date is not possible a refund will be given.
Bookings that need rescheduling, will be re-scheduled within a 3- month period. Additional costs for all the perishable items e.g. flowers, food etc. will be incurred if cancelled less than 72 hours prior to the event.
In case of unexpected bad weather during the event, no refund or rescheduling is permitted. It is the responsibility of the customer to have a plan B location.
Force Majeure:
Magic City Occasions reserves the right to cancel or reschedule events in the event of force majeure circumstances beyond our control, including but not limited to natural disasters, government regulations, or other unforeseen emergencies.
In such cases, Magic City Occasions will work with the client to find suitable alternative arrangements or offer a refund as appropriate.
Intellectual Property:
All designs, concepts, and materials created by Magic City Occasions remain the intellectual property of the company.
Clients may not reproduce, distribute, or use any of Magic City Occasions' intellectual property without prior written consent.
Health and Safety:
Magic City Occasions prioritizes the health and safety of our clients and staff.
We adhere to all relevant health and safety guidelines and regulations.
​Clients are required to inform Magic City Occasions of any relevant health conditions or dietary restrictions of attendees to ensure a safe and enjoyable experience.
Food Safety and Consmption:
Magic City Occasions ensures the safety and quality of the food at the time of delivery / setup.
The client is responsible for ensuring that food is consumed within the recommended time frames to maintain freshness and safety.
The client is solely responsible for letting Magic City Occasions know of any / all food allergens / dietary requirements that needs catering to.
Photography and Promotion:
Magic City Occasions reserve the right to take photographs of our event set ups and styling for our social media purposes. The client can opt out of being in any promotional photography by giving Magic City Occasions written notice.
We welcome photos from you and reserve the right to use these in our promotional platforms.
Indemnification:
The client agrees to indemnify and hold harmless the company provider ‘Magic City Occasions’ from any claims, liabilities, or costs arising from the event.
The client agrees to indemnify, defend and hold harmless Magic City Occasions, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Magic City Occasions reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Magic City Occasions in asserting any available defenses.
Privacy Policy:
Magic City Occasions respects the privacy of our clients and will not disclose personal information to third parties without consent.
By engaging our services, clients consent to the collection and use of their personal information for the purpose of fulfilling the booking and providing a tailored experience.
Liability and Insurance:
Magic City Occasions shall not be held liable or responsible for any damages, injuries, incidents, death or losses incurred during or from the event, including but not limited to accidents, theft, loss of income or property damage.
Clients are responsible for ensuring the safety and supervision of all attendees, especially children, during the event.
​All equipment is hired and is the responsibility of the client until returned to the hire company.
The client is advised to have event liability insurance to cover any potential incidents.
Waiver and Release of Liability:
In consideration of the risk of injury while participating in Magic City Occasion services (the "Activity"), and as consideration for the right to participate in the Activity, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Activity, and do hereby release and forever discharge Magic City Occasions, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my participation in the aforementioned Activity, including traveling to and from an event related to this Activity.
I am voluntarily participating in the aforementioned Activity and I am participating in the Activity entirely at my own risk. I am aware of the risks associated with traveling to and from as well as participating in this Activity, which may include, but are not limited to, physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. I understand that these injuries or outcomes may arise from my own or others' negligence, conditions related to travel, or the condition of the Activity location(s). Nonetheless, I assume all related risks, both known or unknown to me, of my participation in this Activity, including travel to, from and during this Activity.
I agree to indemnify and hold harmless Magic City Occasions against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If Magic City Occasions incurs any of these types of expenses, I agree to reimburse Magic City Occasions.
I hereby certify that I understand the above risks associated with this activity and agree that Magic City Occasions shall not be responsible for any injuries or losses during any event and service.
Additionally, I agree to be held solely responsible if my negligence, willful misconduct, or disregard for the rules of activity name leads to damage to others or to Magic City Occasions property. I agree to voluntarily give up or waive any right that I otherwise have to bring a legal action against Magic City Occasions for personal injury or property damage. In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.
Any legal manners arising from this release of liability shall take place in the state of Florida as agreed.
Governing Law and Jurisdiction:
These terms and conditions shall be governed by and construed in accordance with the laws of the State of Florida.
Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Miami-Dade County.
